2. Definitions
- "Site" means the public website available at socium.link and its public subdomains.
- "Platform" means the Socium human resources and payroll software, available to customers under contract.
- "User" means any person accessing the Site, whether a customer or not.
- "Publisher" means the company identified in section 1.
3. Scope: the Site is not the Platform
These terms cover the public Site only. They do not govern use of the Socium Platform, which is subject to a separate services agreement between the Publisher and each customer, together with a data processing agreement where applicable.
Where these terms conflict with a services agreement, the services agreement prevails in all matters concerning the Platform.
4. Access to the Site
The Site is free to access. Access and equipment costs (device, connection) remain the responsibility of the User.
The Publisher endeavours to keep the Site continuously available but is under no obligation to do so. Access may be interrupted for maintenance, updates, or because of an event beyond its reasonable control.
5. Demonstration requests and downloadable content
The Site offers forms allowing visitors to request a demonstration or download documentary resources. Users undertake to provide accurate and current information.
A demonstration request constitutes neither a firm offer nor a contractual commitment by either party. The associated data processing is described in the privacy policy.
Forms are protected against automated submissions by an anti-bot verification mechanism.
6. Intellectual property
All elements of the Site — trade marks, logos, text, illustrations, interfaces, video, structure and code — are protected by intellectual property law and remain the exclusive property of the Publisher or its partners.
Any reproduction, representation, adaptation or exploitation, in whole or in part, without prior written authorisation is prohibited. Quoting short extracts remains permitted provided the source is clearly identified and linked to the Site.
Customer and partner trade marks and logos displayed on the Site remain the property of their respective owners and are used with their consent.
7. Prohibited uses
Users undertake in particular not to:
- hinder or disrupt the operation of the Site, including through abnormal load or intrusion attempts;
- systematically extract or reuse all or part of the content, including by automated scraping;
- circumvent security measures or access restricted areas without authorisation;
- use the Site for unlawful purposes or in breach of applicable law, in particular Law No. 2008-11 of 25 January 2008 on cybercrime.
8. Liability
Information published on the Site is provided for guidance only. Content relating to the social security and tax rules of the countries covered — including contribution rates, tax bands and simulations — is provided for illustration: it constitutes neither legal nor tax advice and cannot replace the opinion of a qualified professional in the country concerned.
The Publisher cannot be held liable for indirect damage arising from use of the Site, nor for the inaccuracy or obsolescence of any regulatory information published.
9. Third-party links and services
The Site may link to third-party sites or embed content hosted by third parties, in particular video. The Publisher exercises no control over these resources and accepts no responsibility for their content or practices.
10. Personal data and cookies
Processing of personal data carried out through the Site is described in the privacy policy. Trackers placed on the User's device are detailed in the cookie policy.
11. Changes to these terms
The Publisher may amend these terms at any time. The applicable version is the one published on the Site at the time of consultation; its update date appears at the top of the page.
12. Governing law and jurisdiction
These terms are governed by Senegalese law, in particular Law No. 2008-08 of 25 January 2008 on electronic transactions.
Failing an amicable settlement, any dispute concerning their interpretation or performance falls within the jurisdiction of the courts of Dakar, Senegal.
