Leave management Ivory Coast employers deal with combines three layers of rules: the Labour Code (Law No. 2015-532 of 20 July 2015, amended by Ordinance No. 2021-902 of 22 December 2021), Decree No. 98-39 of 28 January 1998 on paid leave, and the inter-professional collective agreement, not forgetting sector agreements. For an HR director in Abidjan or a finance director overseeing branches in Bouaké, San-Pédro or Yamoussoukro, the goal is simple: accurate balances, an allowance calculated on the right basis and no leftover leave forgotten when an employee leaves. Here are the rules to configure and how to keep them on track over time.

How many days of leave does an employee accrue?

Unless the collective agreement or the contract is more favourable, the worker accrues 2.2 working days of leave per month of actual service (Article 25.1 of the Code), or 26.4 working days for a full year. The right to actually take leave opens after one year of actual service (Article 25.4), and leave must be taken within the twelve months following hiring or the return from the previous leave (Article 25.5).

The reference period runs from hiring, or from the return from the last leave, until the day before the next departure (Decree No. 98-39, Article 3). Each employee therefore has their own period, which quickly makes spreadsheet tracking complicated once hires are spread across the year.

Absences that do not reduce entitlement

The following are not deducted when calculating days accrued: absences due to a workplace accident or occupational disease, trade union training, maternity leave and, up to six months, illness certified by an approved doctor (Article 25.3). Maternity leave lasts fourteen weeks. Other unpaid absences may reduce accrued entitlement: your written policy should say so.

Extra days: seniority, children, long-service medal

The 2021 ordinance rewrote Article 25.2. Unless more favourable terms apply, annual leave is increased according to length of service with the company:

Length of service with the companyExtra working days per year
After 5 years1
After 10 years2
After 15 years3
After 20 years5
After 25 years7
After 30 years8

The same article grants two extra working days per dependent child, under age conditions assessed on the last day of the reference period: every child counts for the youngest employees, and only from the fourth child onwards for older ones. Holders of the médaille d'honneur du travail (the long-service medal) earn one extra day per year. A worker housed on the premises they guard and required to be present around the clock receives two extra weeks.

A point to watch: the old 1998 decree and the collective agreement set out different seniority scales. The Code as amended in 2021 now sets the minimum; apply the rule most favourable to the employee and document your choice in the configuration.

Special leave and public holidays

An employee with at least six months' service is entitled to paid special leave that is not deducted from annual leave, up to ten working days per year (Article 25.12):

  • the worker's own wedding: 4 days; wedding of a child, brother or sister: 2 days;
  • death of a spouse, child, father or mother: 5 days; of a brother, sister, father-in-law or mother-in-law: 2 days;
  • birth of a child: 2 days; christening, first communion, moving house: 1 day.

The leave must be authorised in advance; in cases of force majeure, supporting documents must be provided within fifteen days at the latest. If the event takes place far from the place of work, unpaid travel time of two days (under 400 km) or three days (beyond) is added. These rules translate directly into absence types in your tool, each with its cap.

On the calendar side, the list of public holidays is set by decree; the national holiday and 1 May are public holidays, days off and paid (Article 24.2). Religious holidays on variable dates mean the calendar has to be updated during the year.

Calculating the leave allowance

This is the step where leave management Ivory Coast teams handle meets payroll.

The employer pays the allowance at the time of departure (Article 25.7). It includes commissions, bonuses and benefits that do not reimburse expenses, based on the monthly average over no more than the last twelve months (Article 31.9). The 1998 decree sets it at one twelfth of total remuneration for the reference period. The inter-professional collective agreement specifies a practical method: average monthly salary over the last twelve months, divided by 30, multiplied by the number of calendar days of leave. Meal, transport and travel allowances remain excluded.

Worked illustration

Take a branch manager in Abidjan whose average gross remuneration, including bonuses and overtime, comes to 900,000 FCFA per month over the last twelve months. His average daily salary works out at 30,000 FCFA. If he takes 30 calendar days, the allowance is 900,000 FCFA; if he splits his leave and takes 14 days, it is 420,000 FCFA for that portion. These amounts illustrate the method and are no substitute for reading your sector agreement.

Splitting, carry-over and final settlement

With the employee's agreement, leave can be split provided that a period of at least fourteen consecutive days is taken (Article 25.6). Carry-over is possible where the collective agreement allows it, with the worker's consent. Under the inter-professional collective agreement, a fixed date cannot be brought forward or pushed back by more than three months without the labour inspector's authorisation.

At the end of the contract, an indemnity calculated on the entitlement accrued at the date of termination is due (Article 25.8). For workers hired by the hour or by the day for temporary work, the compensatory indemnity, equal to one twelfth of the remuneration earned, is paid with the salary (Article 25.9). Outside these cases, replacing leave with a payment is void (Article 25.11): the practice of “buying back” leave every year exposes the company.

Planning leave management Ivory Coast without disrupting operations

The order and dates of departure are set by the employer, taking account of operational needs and, as far as possible, the employee's wishes; the employee must be informed at least fifteen days in advance (Article 25.5). The collective agreement adds that the departure schedule must be posted and the employee given a slip stating the dates of departure and return. In practice, this means:

  • an annual plan per department, agreed before peak periods (the coffee and cocoa campaign, year end, the start of the school year);
  • a rule on simultaneous absences per team, applied when the request is made;
  • an alert when an employee approaches the end of their twelve-month window without having booked leave;
  • a departure slip generated automatically, signed or accepted from a mobile phone.

The right tool for leave management Ivory Coast

The most costly errors rarely come from misreading the Code, but from scattered tracking: a reference period per employee, seniority extras that change on anniversary dates, capped special leave and an allowance that depends on twelve months of payroll. Reliable leave management Ivory Coast therefore connects absences to payroll.

Socium's leave management Ivory Coast module calculates entitlements according to the configured rules, handles requests from the mobile app (lightweight, usable on 3G), routes them for manager approval and passes the allowance to compliant payroll in Ivory Coast.
